Eligibility:  NBA 2K League Pick’ Em (the “Promotion”) is open only to individuals who are legal residents (natural persons only) and physically located in one (1) of the fifty (50) United States or the District of Columbia, and who are eighteen (18) years of age or older (or of the legal age of majority in their state of residence, whichever is older) at the time of entry (each, an “entrant”).  Employees, officers, managers, directors, representatives and agents of NBA 2K League, LLC (“Sponsor”), the NBA 2K League and its teams, NBA Properties, Inc., NBA Media Ventures, LLC, Take‑Two Interactive Software, Inc., NBA Digital, the National Basketball Association (“NBA”) and its member teams, LLC, Tally Technology Group Inc., Turner Networks, and each of their respective parent companies, subsidiaries, affiliates, related entities, officers, governors, owners, distributors, retailers, agents, and advertising/promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate in the Promotion or receive a prize. Void where prohibited by law. Promotion is subject to all applicable federal, state, and local laws.

Promotion Period: Promotion begins at 11:00:00AM Eastern Time (“ET”) on 5/19/21 and ends at the conclusion of the 2021 NBA 2K League TIPOFF tournament (“Promotion Period”). All dates are subject to change dependent upon the NBA 2K League official game schedule. During the Promotion Period, there will be four (4) periods during which entries may be accepted (each a “Game Entry Period”); as set forth below, prizes will be awarded to high scorers for each Game Entry Period and on an aggregate basis to the highest scorer across all Game Entry Periods, determined by taking the sum of points earned in each Game Entry Period.  See below for more information on scoring.

How To Participate: During the Promotion Period, visit the Promotion Website, fully complete the free registration process and, following all provided instructions, use your knowledge and skill to answer questions for each Game Entry Period.  Regardless of any stated Promotion Period or Game Entry Period, no entries can be submitted for a Game Entry Period until and unless questions are posted for such Game Entry Period.  The Sponsor reserves the right not to post questions for any Game Entry Period at its discretion, in which case, notwithstanding anything herein to the contrary, no prizes will be awarded for such Game Entry Period. All answers must be accepted and acknowledged by the Promotion computer servers by the applicable deadline (as determined by the Sponsor) to be considered valid, timely, and eligible.  Limit of one (1) entry per person per Game Entry Period.  Released Parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, undelivered, misdirected, damaged, or garbled entries; any error, omission, interruption, defect or delay in transmission, interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; incomplete entries or communications; printing, typographical or other errors appearing within these Official Rules, in any Promotion‑related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, computer, electronic, mail or otherwise relating to or in connection with the Promotion, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prize, or the cancellation or postponement of any events or games.  Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion.  ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING THE PROMOTION WEBSITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.   Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with these Official Rules may be disqualified from the Promotion at Sponsor’s sole and absolute discretion.  The use of automated or similar devices, which subvert the entry process, including but not limited to entries submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry), or multiple social or email accounts to enter this Promotion is prohibited and entries through such devices and accounts are void. The Promotion Website’s database clock will be the official timekeeper for this Promotion.  Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void.  Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of the Sponsor may be disqualified.

Promotion Entry Assignment of Rights:  Entrants warrant and represent that (1) Sponsor shall own the entry (and all material and rights embodied therein) and that such entry will not be acknowledged or returned; and (2) that by entering, the entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the entry including but not limited to all intellectual property rights; and (3) that Sponsor and its designees shall have, without limitation, the perpetual non-exclusive right worldwide to edit, adapt, modify, publish, exploit and use the entry, in any way and in any and all media now known or hereinafter discovered or devised, worldwide for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to, entrants or any third parties. Entrants further agree to abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding.

Winner Determination and Scoring:

The entrant with the highest point score for each Game Entry Period, as determined by the Sponsor, will be declared the Daily Grand Prize winner for the applicable Game Entry Period. The entrant with the highest sum of scores across all four (4) Game Entry Periods, as determined by the Sponsor, will be declared the Overall Grand Prize winner. Points awarded are expected to be displayed on the Promotion Website at the conclusion of each Game Entry Period or shortly thereafter.

The number of points awarded for a correct answer, which will be shown on the Promotion Website, will be inversely related to the percent of people who also provided such correct answer (e.g., more points for a correct answer that fewer people gave). No points will be awarded for incorrect answers.

Additional points may be awarded or deducted for other actions or predictions that are part of the Promotion Website, as determined by Sponsor at its discretion, from time to time during one or more of the Game Entry Period.

The Sponsor reserves the right to add or change how points can be earned. Such changes or additions will not materially change the overall manner in which the Promotion is operated or the processes for determining the winners for any Game Entry Period. Whether any answer is right or wrong will be determined by Sponsor and/or its designees in their sole discretion.  Odds of winning depend on the entrant’s skill at answering questions and the number of eligible entrants.  The tabulation of points/scores and identification of potential winners will be conducted by the Sponsor and/or its designees, whose decisions are final and binding with respect to these Official Rules and in all other matters relating to this Promotion, including tabulation of points/scores for each Game Entry Period.

Sponsor will attempt to notify each potential prize winner via email or SMS. The potential prize winner is subject to eligibility verification and compliance with these Official Rules. Prize will be awarded to the person named in the applicable registration (subject to verification of eligibility and the terms of these Official Rules).  In the event of a dispute as to the identity of any entrant, the entrant will be deemed the authorized account holder of the e-mail address submitted at the time of registration provided that such individual is eligible and such individual complied with these Official Rules.  “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor.  In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s e-mail account to receive e-mail messages.  The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information.

Prizes: 

Four (4) Daily Grand Prizes: A prize consisting of one (1) code redeemable for a virtual item in one (1) or more version(s) of the NBA 2K21 videogame; ARV = $5.00

One (1) Overall Grand Prize: A prize consisting of one (1) piece of Champion brand merchandise to, one (1) DoorDash gift card with a value of at least twenty‑five dollars ($25), and one (1) code redeemable for a virtual item in one (1) or more version(s) of the NBA 2K21 videogame; ARV = $45.00

Gift card is subject to all applicable terms, rules and laws governing use of such gift card.  All prize details (e.g., size, color, etc.) are at the Sponsor’s sole discretion. Merchandise is not game‑used. Total maximum ARV of all prizes: $65.00.

Miscellaneous: There shall be no transfer, assignment, cash redemption, or substitution of prizes (or any portion thereof) except by Sponsor, who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value at its sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. All federal, state, and local taxes (including income and withholding taxes, if any) and all other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded are winners’ sole responsibility. The potential prize winners may be required to execute and return a prize claim form within three (3) day of the time of issuance. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification and awarding of a prize to an alternate winner, at Sponsor’s sole discretion and time permitting.  If any prize notification email or letter or any prize is returned as undeliverable, in the event of non-compliance with these Official Rules, if a potential winner fails to execute and return all required documents within the specified time period, or if Sponsor is unable to contact a potential winner within a reasonable time period, such potential winner will be disqualified and, at Sponsor’s discretion and time permitting, an alternate potential winner may be selected.  Sponsor, in its sole discretion, reserves the right to: 1) disqualify any person who tampers with the entry process, the operation of the Promotion Website or NBA2KLeague.com, or any other component of this Promotion, or who is otherwise in violation of these Official Rules; and 2) modify, suspend or terminate this Promotion for any reason, as determined by Sponsor in its sole discretion, including should virus, bug, worm, unauthorized intervention or other causes, including but not limited to war, strikes, terrorist activities, medical epidemic, other public health situation and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Promotion and, in the event of termination, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event requiring such termination. By participating, entrants agree to be bound by these Official Rules and agree that: 1) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant’s name, voice, city/state/province/territory of residence, biographical information, photograph, social media account information and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting his/her name on NBA2KLeague.com and affiliates websites and/or for TV or radio broadcasts and/or for any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification; and 2) Released Parties are released, will have no liability whatsoever for, and shall be held harmless by entrants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Promotion, including any travel or related activities associated with the foregoing.

Arbitration: Except where prohibited by law, as a condition of participating in this Promotion, entrant agrees that: (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and entrant further waives all rights to have damages multiplied or increased.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s law.

Entry Information and Promotion Communications:  As a condition of entering the Promotion, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Promotion and to comply with applicable laws, regulations and rules.  Any information entrants provide to Sponsor may be used to communicate with entrant in relation to this Promotion or on a Promotion winners list.   The information provided by entrants will be used pursuant to the NBA’s privacy policy available at https://www.nba.com/news/privacy_policy.html and Take‑Two Interactive Software, Inc.’s privacy policy available at https://www.take2games.com/privacy/.
