Eligibility: The BFW Live Giveaway (hereafter, “Promotion”) is open to legal residents (natural persons only) of the fifty (50) United States and the District of Columbia who are at least the age of majority in their state of residence at time of entry: 18 years of age in most states, 19 in Alabama and Nebraska, 21 in Mississippi. Employees, officers, managers, directors, representatives and agents of NBA 2K League, LLC (the “Sponsor), the NBA 2K League and its teams, NBA Properties, Inc., NBA Media Ventures, LLC, NBA Digital, the National Basketball Association and its member teams, Take‑Two Interactive Software, Inc., Anheuser‑Busch, LLC, Kingston Technology Company, Inc., Turner Networks and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, agents and advertising/promotion agencies (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize. Promotion is subject to all applicable federal, state, and local laws. Void where prohibited by law. Only Twitch members are eligible to enter. Twitch membership is free and may be obtained by logging on to  www.Twitch.tv and following the on‑screen prompts to create a profile. Each entrant must be the rightful owner (or have authorized use) of the email address associated with the Twitch account used for entry. In the event of a dispute as to the identity of a winner, the winner will be deemed the natural person in whose name the email account associated with the Twitch profile was opened. Twitch is neither a Sponsor of nor affiliated with this Promotion. By entering, you understand that you are providing your information to the Sponsor.  Any information entrants provide to Sponsor may be used to communicate with entrant in relation to this Promotion or on a Promotion winner’s list.   The information provided by entrants will be used pursuant to the NBA’s privacy policy available at http://www.nba.com/news/privacy_policy.html and Take‑Two Interactive Software, Inc.’s privacy policy available at https://www.take2games.com/privacy/.

Promotion Period: The Promotion begins on 7/14/20 at the beginning of the BFW Live stream on the NBA 2K League’s Twitch channel (approximately 5:30:00 PM Eastern Time (“ET”)) and ends on 7/14/20 at a time to be determined at the Sponsor’s discretion during the BFW Live stream on the NBA 2K League’s Twitch channel (the “Promotion Period”).

How To Enter: During the Promotion Period, follow the following steps in order to enter:

• Log in to your Twitch profile from your computer, phone or other device during the Promotion Period;
• Go to https://www.twitch.tv/nba2kleague; and
• Comment on the stream using the hashtags #BFWLive #Giveaway to receive one (1) entry into the Promotion.

Entrants may earn one (1) entry per person for the duration of the Promotion Period.

Entrant’s Twitch account must be public in order to enter. Comments that do not follow the above format may be discarded or ignored. Incomplete comments, comments received after the applicable Promotion Period deadline, and/or comments which may contain obscene, offensive, or any language communicating messages inconsistent with the positive images with which the NBA 2K League or the Sponsor wishes to associate will be void. Subject to Twitch Terms of Service & except where otherwise prohibited, all winning entries become property of the Sponsor & will not be acknowledged or returned. All entries must comply with the Twitch Terms of Service & Twitch rules available at www.twitch.tv/p/legal/terms-of-service.

Limit one (1) Entry per Twitch account. Entries received from any Twitch account in excess of the above stated limitation will be void. The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of entry) to enter the Promotion is prohibited and any entry through such means, and any entry that is deemed to be ineligible (at the Sponsor’s sole discretion in accordance with these Official Rules) will be void. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate or undelivered comments, direct messages or entries, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellites, networks, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the Internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing of direct messages, comments or entries, the announcement of a prize, for any injury or damage to participant’s or any other person’s computer or other device relating to or resulting from participation in this Promotion, or for printing, typographical, human or other errors appearing in these Official Rules or other Promotion-related materials. The Sponsor reserves the right, in its sole discretion, to void any entries of entrants and disqualify such entrants whom the Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion and/or who are in violation of these Official Rules.

Drawings: Prize winners will be selected in an individual random drawing on/about 7/14/20 from among all eligible entries received during the Promotion Period. Drawing will be conducted by Sponsor.  By participating, entrants agree to the terms of these Official Rules and to the decisions of the Sponsor, which will be final and binding in all matters relating to the Promotion. Potential winners will be notified by Sponsor via Twitch Direct Message and must respond within five (5) days. Odds of winning will depend on the total number of eligible entries received. Limit one (1) prize per person, per household, per Twitch account and per e-mail address.

Prizes:  One (1) Prize: One (1) HyperX Cloud Orbit headset (Approximate Retail Value (“ARV”)=$199.99).  Prize is awarded “as is” without any warranty or guarantee, either express or implied. All prize details are at the Sponsor’s sole discretion. In the event that any prize component is not available the Sponsor reserves the right to replace the merchandise with a prize with a comparable or greater value at its sole discretion. All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes are the winner’s sole responsibility. Total ARV of all prizes=$199.99.

Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize is permitted except by the Sponsor, who reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion and except as otherwise provided herein. Potential winners will be required to provide their respective shipping address within five (5) days of date of issuance of notification. Non‑compliance with any of the foregoing or with these Official Rules may result in disqualification and awarding of prize to an alternate winner, at the Sponsor’s sole discretion and time permitting. If potential prize winner’s Twitch Direct Message, notification or prize is returned as undeliverable, or if a potential winner fails to respond to such Twitch Direct Message within five (5) days, potential winner will be disqualified and time permitting, an alternate winner may be selected for the applicable drawing at Sponsor’s sole discretion. By participating, entrants agree to be bound by these Official Rules and agree that: 1) The NBA 2K League, the Sponsor and their designees may use (unless prohibited by law) entrant’s name, city and state of residence, photograph, biographical information, any oral or written statements, and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, to the acceptance, possession, use or misuse of a prize and any related activity thereto or participation in this Promotion. The Sponsor reserves the right, in its sole discretion, to terminate this Promotion (or any portion thereof) for any reason, including should virus, bugs, worms, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion or for any other reason and, in the case of termination, at its discretion, select the winner(s) for the drawing(s) at issue from eligible non‑suspect entries received for the applicable drawing(s) prior to the event that required such termination.

CAUTION: Any attempt to deliberately damage any involved website or app or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws and, should such an attempt be made, the NBA 2K League and the Sponsor reserve the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.

Arbitration: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and the NBA 2K League and the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
